These Terms and Conditions (T&C) govern the use of the Taxiloyal and Seniorentaxi platforms (hereinafter referred to as âTaxiloyalâ) for the mediation of rides to licensed taxi companies and drivers.
Taxiloyal only mediates rides between passengers (customers) and independently operating partner companies.
Taxiloyal itself does not provide any transport services and does not act as a transport company.
By using the platform, no transport contract is concluded with Taxiloyal.
Taxiloyal merely forwards the booking request to an independently licensed taxi company or driver (hereinafter referred to as âpartner companyâ).
The transport contract is concluded exclusively between the customer and the executing partner company.
Taxiloyal is not a party to the transport contract and has no influence on its execution, duration, or pricing.
Taxiloyal undertakes to cooperate only with legally operating and licensed taxi companies.
Before cooperation begins, Taxiloyal verifies that each company holds a valid business license for passenger transport and that all drivers possess a valid taxi driverâs license.
Taxiloyal documents these checks with due care but assumes no responsibility for subsequent legal violations or actions of partner companies.
After a booking request, Taxiloyal forwards the inquiry to suitable partner companies.
As soon as a partner company accepts the ride, the customer is notified. With this notification, Taxiloyalâs mediation service is deemed fully provided.
Execution of the ride, pricing, vehicle condition, and driver behavior are the sole responsibility of the executing company.
Taxiloyal is only liable for damages resulting from its own intentional or grossly negligent breach of duty in connection with the mediation service.
Taxiloyal accepts no liability for damages arising during the transport itself (e.g., delays, cancellations, driver behavior, vehicle defects, luggage loss), which are the sole responsibility of the executing partner company.
Taxiloyal is not liable for incorrect customer information or for technical failures of third-party providers (e.g., map, navigation, or payment services).
Ride prices are determined solely by the executing partner companies according to the applicable tariff regulations (e.g., Vienna Taxi Tariff).
Payment is made directly to the executing company or driver. Taxiloyal does not accept any customer payments.
Exception: For registered corporate clients, delivery-note rides may be arranged, which are billed afterwards by the respective partner company.
Taxiloyal may receive a mediation commission from partner companies, which does not affect the customerâs fare.
Invoices for transport services are issued exclusively by the executing company.
Taxiloyal does not issue invoices for rides but may send booking confirmations or receipts electronically.
Partner companies and their drivers must comply with all legal requirements under the Passenger Transport Act, the Trade Regulation Act, and the Taxi Driver Ordinance.
They act on their own responsibility and bear sole liability for violations, damages, or breaches of duty toward customers or third parties.
Taxiloyal reserves the right to exclude partner companies from the platform in the event of violations or repeated complaints.
Taxiloyal processes personal data solely for the purpose of mediating booked rides in accordance with the GDPR and the Austrian Data Protection Act.
Customer data is transmitted only to the executing partner company, insofar as this is necessary for the performance of the ride.
Further details are provided in the Privacy Policy available on this website.
Users are required to provide truthful information when registering and booking.
Taxiloyal reserves the right to suspend accounts if false information is provided or bookings are misused.
Technical changes, maintenance work, or temporary outages may occur at any time; continuous availability cannot be guaranteed.
Users are responsible for any costs related to internet access, data transmission, and their own devices.
The platform offers registered companies (hereafter âsubcontractorsâ) the possibility to publish their own trips for mediation via the system in order to receive support from other partner companies. The platform itself does not provide passenger transport services, but only the technical infrastructure through which trips are published and can be accepted by other companies.
The platform does not guarantee or assume liability that the published trips will actually be mediated, accepted or carried out. Each company is responsible for regularly checking the status of its published orders and taking alternative actions in a timely manner if no acceptance occurs or a trip is canceled by the executing driver.
The transport or cooperation contract is concluded directly between the companies involved. The platform operator is not a contractual party to these transport relationships and assumes no liability for non-fulfilment, delays, cancellations or other breaches of duty by the participating companies or drivers.
For incorrect or incomplete information when registering trips (e.g. incorrect destination addresses, times, price information or customer data), only the company that published the respective trip is liable. Any additional costs or processing fees arising from this will be charged to that company.
Subcontractors may charge a mediation fee of up to 10% of the trip fare to the executing company for trips they have published themselves and successfully mediated via the platform. The amount of this fee is visible in the respective mediation offer and is accepted by the other company upon acceptance of the trip.
These Terms are governed exclusively by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all disputes arising from or in connection with these Terms shall be Vienna, Austria.
Should any provision of these Terms be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that comes closest to the intended economic purpose.
Taxiloyal reserves the right to modify, suspend, or further develop the platform or its functions in a reasonable manner.
